What is Loss Mitigation? Loss mitigation is a set of solutions that consists of a variety of procedures set up by the government and lenders to assist homeowners threatened by foreclosures. The goal of loss mitigation is to help the homeowner stay in their home and protect their credit history.

Why will the bank negotiate with you and not me?

Most mortgage companies are not equipped to deal with requests for loan modifications from their customers, and because most homeowners are not aware of their rights, the modification is less likely to be approved.

Can you help someone with bad credit?

Even with very poor credit, a positive modification of loan rate and terms is possible.

What if I owe more than my home is worth? This is the case with most homeowners today. Fortunately, through our negotiation services, these homeowners are still able to modify their loan.

How will the government bailout help me? The government is telling banks they need to do their part to fix the housing crisis. The Bail Out Bill will only help your chances of getting a Loan Modification. However, it will not finance your Loan Modification.

How long do I have to act? Time is of the essence when you are behind on house payments. The federal government's own research shows that a homeowner has a much greater chance of receiving benefits with professional representation in the loss mitigation process.

What is predatory lending?

The practice whereby a creditor puts a borrower into a loan that the borrower will probably not be able to repay. Federal laws like TILA and RESPA require creditors to disclose certain loan terms and most often they are not or disclosed inaccurately. Predatory lending tactics include the classic bait and switch. Elderly abuse this is common in the industry. The elderly are preyed upon and put into programs they cannot afford or need. Both federal and state law prohibit the mortgage industry from providing different loan terms to people based on race, sex, ethnicity, or other protected class. Other examples are excessive fees, abusive pre payment penalty, kick back to brokers, loan flipping, mandatory arbitration, steering and targeting.
