It seems to be happening less at this time in my area.  When the market was full of short sales a couple of years ago, I found many Realtors that were  overstepping and asking my sellers inappropriate questions.  I always instruct my sellers to have the agents contact me directly if they start asking contractual type questions.  I have had to contact brokers about their agent's conduct, which I really don't like to have to do.

Sending a mailing to a neighborhood (with the proper disclaimer, of course) is one thing. I don't know anybody that cross checks active listings before a mailing.  That's why the disclaimer is present.  If they are contacting them in person that's another. And they should be reported to the MLS and the local board.

There have always been agents ready to throw you under the bus.

There have always been agents who choose not to purge mailing lists of listed addresses.

There have always been agents who resent your presence in the market place and will be truly small minded about it.

There have always been agents who will take the opportunity to chat with your client and misrepresent the situation.

It is the assurance that such actions will be exposed to the professional community, not the code of ethics, that restrain this activity. And if you are with a really big office, that exposure could be crippling.

Always instruct your seller to keep all real estate mail they receive for your review.

I am not seeing MORE Realtor behaving badly. Quite the opposite. I am impressed with the level of knowledge, the commitment to purpose, the expedient execution, the willingness to do whatever it takes,and the graciousness exhibited when things go wrong, and there is always something, shown by the professionals I have the privilege to work with.

People are either ethical or not.  I think ethics classes are the most helpful to sociopaths who need to know what ethical behavior looks like so they can appear to be what they're not.

I haven't noticed any change in the behavior or amount of shady realtors.
