It sounds like misrepresentation to me and if you can find out who they called to come and do the cover up the buyer may have a good case. It sounds like it will be expensive to repair and they may need to see an attorney.

Hi Sharon - based on what you have presented, I would suggest the client contact an attorney for legal counsel.  Hopefully, there is documentation regarding conversations and any disclosures made by the seller and the listing agent.

You could take the seller to court.  But I would have your broker mail a certified letter stating the repair cost for all the items the buyer had to fix when moving in.  If he does not comply with the letter with paying the buyer.  It maybe good for the buyer to consult with a Real Estate law attorney and see if they have a case.

If this home were sold as a foreclosure, what would you do?

How about, if this home was sold as 'non resisdent' owner? What would you do?

If home was sold "As-Is" with right to inspect, what would you do?

Since the owner DID attempt to conceal the condition of the home,  which much different than the three previous situations, the buyer should weight their cost to determine the extent of risk, then send the seller an attorney drafted letter requesting a specific compensation amount.  For a couple hundred dollars, the buyer may be able to shake the past owner enough to be compensated.

And if the listing agent was aware, the buyer should consider adding a little mortivation to the listing agents need to get this wrapped up quickly.

Depends on state laws on how disclosure or lack thereof is handled. I would recommend to my client that they cancel the contract.
