I only use BBA in very selective situations. I rely on my loyalty programs to keep buyers committed.

If my intuition alerts on a citizen as a waste of time I pull out the BBA and allow them to de-select.

"Oh, I'm sorry you feel that way. But I have 'The List" of agents who I know won't require you to sign a BBA."

No, I don't use them.  I do feel that they are binding an enforceable.  They also make a client have to work with someone that may not be looking out for their best interest or be compatible.  I've seen many times where a client won't do anything until the contract has expired.  Is this really the right way to do business.  I wouldn't sign one so therefore I wouldn't make someone else sign mine.

If they refuse to sign, just let them know that you invest your time in them and commit to them - you want the same in return.

I am mostly a buyers agent.  Since I am not going to take clients to court over it, I do not ask they sign it until they are ready to make an offer.  Sure, I have been burned a few times.  But those same people would have burned me regardless and I know for a fact (cause I have asked after wards) several clients would not have started working with me had I demanded it.  Look, TRUST has to be earned by both parties.  Once they are ready to write a contract, I have them sign it.  There is implied agency regardless when I show a property.  My wife is a real estate attorney, she has a good laugh anytime I mention the buyer broker agreement and taking clients to court with it.  I would not enforce it, and use my gut when I meet new buyers.  I turn them down when I feel they will be a waste of time.  I also try (and still learning many lessons on this) to cut out people with malice in their hearts.  They are like a cancer.

I have used them and yes, I get alot of buyers who dont want to sign them but those tend to be people who aren't loyal anyway.  Its just not that common in this area.

I use it all the time and rarely have enybody refuse to sign it (and commit to working with me).

I do not push it on our first meeting, but I make it known that my time is my most valuable commodity.  I will show one or two homes on one occasion and after that we will have to be under contract to each other and exactly what that means for them.

I believe it's a matter of the consumer seeing that you're not a, excuse this, "pushy salesperson" and that you have their best interests in mind.

Yes I use it but a lot of the older clients do not like it and I will still work with them.

Personally if we are taking care of the client we shouldn't need it.

Yes.  Financial pre qualification and buyers rep agreement are required.  If they refuse (few do) I will not work with them.  End of story.
