One of our past Designated Brokers didn't appreciate us leaving to go to Keller Williams, so the day after they presented the final invoice to us for payment within 30 days, they had the temerity to file a lawsuit for the invoice!!  The invoice was paid within 3 days (as it would have been without the lawsuit) and 27 websites that were out of compliance (associated with his brokerage) were reported.  All were instructed by the Commissioner to become compliant.  I made sure the agents impacted were aware of what had prompted this action.  The individual they held responsible was the broker - not me.

I've reported several, one in particular for threatening behaviour and attempting to intimidate (FAIL)  This guy's file is about 3' high at this stage and nothing ever gets done.   Another openly admits that his fines are far less than his new business derived from his marketing he gets fined on!

Our indudstry will definitely be as "good" or as "bad" as we the members allow it to be. I have not reported anyone to our local board. I have contacted agents directly and/or their designated brokers (their boss) if the direct approach appears to be failing miserably or otherwise ineffective. My goal isn't to punish. I'm not interested in fines per se. The goal is improved behavior. I do want to work in an ethical environment. And I do want to do what I can to improve the industry. And I do think it's totally OK to report, I just don't usually take that route. The only wrong thing to do is nothing, sit back allow the unethical or incorrect activity/behavior continue.

In Oklahoma City we now have a button we can click on in an MLS listing to report violations. I am following one now that did not disclose foundation issues which is a requirement by law and we busted the contract. If the disclosure is not changed which I suspect this agent won't do I will report it.

Yes, I reported a local agent for conspiring with my seller and purchasing a listing (that I had a valid listing on and in MLS) - I asked that they discipline her and make her pay my commission, she brought an attorney to the hearing that intimidated the board members that heard the case.

They found her guilty and reported her to the Florida Real Estate Commission and placed a letter in her file as punishment.  So she has a record of dishonest dealing. They would not force her to pay my commission nor would the fine her. They advised me to sue her in court. My attorney said it was not worth pursing neither her nor the seller.

She is still practicing real estate today.

I believe the board is only as effective as the people in charge and this group was afraid of possible backlash later on.

As Joe Pryor commented, our MLS has a button that can be selected to report violations but beyond issues that haven't been resolved with a phone call I haven't reported an agent for an ethics violation to our local board.

On a regular basis. Most has to do with no photos. Our board charges $200 per fine so that is the board source for revenue.

I reported 1 to MLS because my photos were used on someone else listing in the same complex. I turned her in because she was passing out her  biz cards with me being present at my open house. I am the owner. She, as the broker , probably has been that way for 25 years....

Yes I did.

Two women wearing their REALTOR badge walked past my sign in the front yard to solicit the owner to let them sell the house! The owner kept their cards for my benefit.

Well I had to throw them under the bus.  To my surprise...Such an egregious violation resulted in no action from the local MLS.

Justification accepted by the MLS was. "The agents reported RedX put the home on the list they were working and that is why the agents knocked on the door to solicit."

Would more reporting change things? What do you think?

More reporting will only give the MLS and NAR reason to claim they are relevant, no benefits exists for the real estate agent...except for those with idle time who like making 17 copies for every member of the mls board.

More reporting means more evidience of need which will always result in higher fees with no benefit.

Sally K. & David L. Hanson at times I do feel like doing it - however, just stop short of reporting. Some agents believe  that they are above code of ethics.

Next time when I deal with them, I work with them with lot of caution.

Not ethics, only MLS violations that can be reported right off the listing and they were not serious. I think there should be more oversight, but even if other agents report and there are no consequences, it will not improve the industry or its image.
