The only way someone else's pics can be on our marketing is via IDX.

Through IDX it's fine but otherwise it's not without permission. The actual MLS rules are pretty complex in terms of the licensing rights we given them by using it

The only possible way to get around that is thru the IDX agreement. You can't take any pics from another agent to use unless you've been in that transaction.

Greg,
I think this is a good practice. The agents we know hire professional photographers to take pictures of their listings. They pay for the photos. They should be the only ones to uses them. A

If you post someones pictures ( from MLS or anywhere else), you might deal with copyrighting fees and very upset agents.
My MLS offers a link to a property website or video tour you can share anywhere ( they do not even allow a listing agent to brand themselves, so buyers agent had a better chance, I guess?).
Here is an example:
http://www.dreamhomephoto.com/4533estrondo/mls.htm
There is no L. agent info there.
I think, you can share any picture from Realtor.com or other sites, they do whatever they want.....

If the listings are via our MLS' IDX, VOW or other data sharing agreements provided through the local board (which own the local MLS) or the Canadian Real Estate Assocation's data feeds and the agent follows all of the rules then it is acceptable.

I think they copyright the photos. The only time I use another agent's photos is with the agent's permission.

We may only do it via IDX feed with MLS approved fields and listing brokerage in the feed.

I do not share anyone's photos without written permission not even MLS photos that are sharable. It is safer that way.

Yes, the person who took the photo owns the copywrite.

Yes, once the photo is loaded to the MLS it becomes the ownership of the MLS

Only via the IDX, or from the street, and only if I took them and am very clear that I can only represent as buyers agent.

IDX searches give you the permission, so long as you follow the IDX display guidelines (basically, give credit where credit is due). Agent permission is needed outside of an IDX, in most scenarios.

Always important to get the other agents permission before using their pics.

I am surprised when I see photos on blogs that are for other agent' s listings.

No, our MLS (HAR.com) does not allow you to use photos from another agent and they will fine you if they have a complaint as such.

IDX allows all MLS listings on our blogs through IDX but i could not use those photos for any other purpose
5,436,290
That is correct in our mls, as well. But if you call and agent and ask for their permission to use one of their photos, that's a different issue.

Good morning Greg. I've heard this before, but I am assuming they allow you to have a link?
4,322,295
Greg Cremia that's strange! We are in 2016 - and information is all over Internet.
May be, you can tell other agent that you'll bring a buyer if he/she allows you to post the pictures of his/her listings.

Same here, I paid for those photos and agents in our office can use them in a blog or face book ad if they wish to try and find a buyer. But I have not read and understood the rules from IDX.
