Head on! How interested are you in getting sued and losing your license? When you know that they are lying, you need to tell your clients what the consequenses are and not to do that. I would flat out not be a party to that.

No... I sit with them when they fill out the form and make sure I ask all the right questions and they get the message not to lie. And then, I also put the fear of God into them about what could happen if they lie about a material fact.

Yes I have. I simply let the buyer's agent know that the seller filled out the seller disclosure statement per the instructions but I knew of one point that was not accurate. And told them what it was. The buyer's did do an inspection and it came up anyway and they did buy the home.

Our disclosures have the option to check "no reresentation". All the attorneys, including at the real estate commission, that i have asked about this say that "no representation" is the only way to answer. So i have my sellers use the "no representation".

No, not intentionally. Rarely, I have had to question them on some of their answers to make sure that is what they intended or didn't intend to disclose, and most times they misinterpreted the question.  They understand from the beginning of the process how important disclosure is.

How would you know they lied is the first question that comes to mind.  I don't pretend to be an expert in this matter.  I am not sure I would work with a person who can not be truthful.

I have never had a seller tell me he lied. I preface the filling out of the form with stating they are to disclose everything they know even if it has been corrected and the buyer would never know.

I've never, ever seen a seller lie on a disclosure.  Many times have I seen them "forget" things, though.  Oh, that giant flood that led to mold?  That was, like, 4 months ago --- totally forgot.

Disclosures are covered up front ... I even have my own "how to complete" the disclosures white paper.  I also go over the completed forms and get clarification if needed.  It is my job to ensure that honestly is used with my transactions.

Lyin' sellers are not my demographic. If they're gonna flat-out lie and be dumb enough to think they can get away with it and arrogant enough to think I'm gonna help, the mutual kickout clause of the listing agreement is shoved up their . . . well, the option to cancel and terminate agency is  exercised by the broker.   3:)

Depends on the nature of the problem.

Some cases one would refer the client to an agent who does not know.

There are other options, but the most common solution is to persuade seller to disclose or walk away.
