Confusion about who represents who. I will only represent one party in a transaction, even though Dual Agency is legal.  I have a pre-existing contractual relationship with my seller and would never think of violating their trust.  I will however assist a buyer, as a customer, not a client, to purchase one of my listings. The details are explained fully and they sign off on the agency disclosure multiple times.  I'm obligated to explain it and document what it means, but when the buyer chooses to reveal information that helps my seller, I'm ethically obligated to take full advantage of it.

In Florida, if there is no written agency disclosure, there is a presumption of "Transaction Brokerage".  Most Buyers and Sellers don't have a clue what that means!

Many can arise, either through the other agent or not.  Dual agency, where allowed, can be your best friend because you can avoid the bad agents (but you also miss getting to know the good ones).  Dual agency MUST be done with everyone's upfront knowledge and consent.

Most don't explain it well and the consumer is confused. In many states the agency laws for real estate make little sense. The politicians vote on what they fail to understand!
