Yes, I read a post Thomas J. Nelson, Realtor posted on Facebook about it. Basically boils down to the buyer didn't read the disclosures he signed and now has sour grapes. There were two different agents on this, but both employed by Coldwell Banker. Not true dual agency, but close. He hasn't sued HIS agent, just the listing agent. This fine upstanding citizen would have sued the listing agent no matter who they were with (IMHO). This is much ado about nothing.

We do not practice dual agency where I represent the buyer and seller. It is very common for a listing agent in a company to have a buyer broker from the same company represent the buyer. It is disclosed when making a showing appointment and again when the offer is out in writing. Not allowing this would shake the industry upside down for buyer agents.

Yet another great reason to have your homes professionally measured prior to listing it. Had the agent paid a professional for that one small (and inexpensive) task, he could have saved this incident from ever happening at all.
I have an issue with both dual agency and the government being involved in too many aspects of our lives! I anxiously await the decision as I'm sure all broker/owners do!

Don't know if Dual Agency is even the issue here, but is turning into the result possibly of abolishing dual agency within a brokerage.
And then you have dual agency where one agent handles both sides, and each side agrees to it. And that works.
I guess in a brokerage, when two different agents each handle either the buyer or the seller, the clients never know they are technically in a "dual agency" relationship? And don't sign off on it? Well, that's a problem that does need fixing.

Oh you bet. There is plenty of discussion and there will be more. The issue is around brokerage dual agency, and duties owed by both agents toward buyer and seller, and a matter that could have a huge impact here depending on the results of the hearing, today I believe.
