Liability can go on as long as that client owns the home you represented them in purchasing. This is why E & O Insurance needs to be continued after leaving the business, at least for a while until you no longer have anything of value that anyone can sue you for in court.

Probably when I pass away. I owe confidentiality forever. I don't believe there is a law that says I have to stay in touch, but I will do that until they tell me to stop.

When the agency relationship is completed, usually at closing or termination of a contract. But there are some responsibilities like maintaining records and privacy that endure beyond termnation.

Hella,
I think that Sandy Padula and Norm Padula, JD, GRI NMLS#1483386 said it perfectly. As long as you have been above board and covered all your bases, you have next to nothing to worry about, which in my opinion is why it is much easier to be honest and transparent at all times. A

My ethics and relationships never cease. I remain in service and responsible for all my clients. The law may say it ends after so much time, but I think if you want clients for life, that's the attitude you need to have.

The Florida Statutes do not say when, Florida Adminstrative Code 61-J2 does not say when.
However, an Attorney told me that the duty of Confidentiality may survive the termination of a Listing Contract or Buyer Brokerage Contract; the duty of Confidentiality may survive the closing on the sale of the property.
