In the instance you describe, I always tell them that I'm unable to work with them because they have an agency relationship with someone else, and their agent will have to provide the search. Your liability, IMHO, is greater interacting with someone else's client than the likelihood of picking up a client.

It depends... afterall, they called you and not you them. It's not considered agent interference if a seller calls you while still listed to discuss their situation. Is this person actually  under an exclusive agency agreement with another agent or just "working" with them? I'd still strongly suggest to these people that they address their questions to their agent.

I don't know Debbie, good question. I know we both use Market Leader. I keep getting people who say they are working with another agent. I email them (no phone number) and ask nicely if they are looking for.information or maybe a more aggressive Realtor in me. 

If they do not answer I delete them.

Is that the wrong approach?

I would look for his agents website and see if there is a reason he isn't getting info from that site. But I wouldn't care if he used my site to search for homes. I just wouldn't initiate any contact with him. If he cheats on his current agent, he'll cheat on you.

I think that it is probably is analogous to talking to a seller who has a listing agreement in place after the seller contacts you - but I still think it is a tough call.

Great question an no right answer. I would keep sending information becasue if the other agent is not client friendly or offers the same abliity to find what they are looking for through that agent, I become the one who makes it simple for them, and have a chance at them. it really doesn't require any effort.

I follow up with everyone that emails me. As others have mentioned, I would direct him back to his agent. I've been in the business a long time and know most of the agent's names that get mentioned. It is well worth it to direct them back in the long run. I sometimes will even call the agent if I know them well and mention their client reached out to me and I directed them back to them. Real Estate is much more than just our relationship with our clients, our other realtors are going to be in business with us long after clients come and go. Being a trustworthy agent is very key to longterm success.

I'll go further and state that I also work with buyers that do not want to continue their relationship with their agent and willing to sign up for my service after successfully terminating their brokerage agreement (usually tough to do) I am sure that I am offering them something their agent cannot and I pay to provide such web service.

I would ask him why he didn't request the information from his agent.  Alot of the searches can be automated so it's not much of an effort anyway.  I'm more inclined to redirect him back to his agent unless he has stated that he is open to working with multiple agents - then you have to decide how much time you want to invest.  I have met several people who tell me "I'll work with the agent that finds me the best deal."  I dont invest too much energy in those people because I want to build relationships with my clients.  I want them to refer me to their friends.

I tell them that I'd be happy to be their agent and work with them to find them the right property.  They would need to stop working with the existing agent and I would make someone in this instance sign a buyer/broker agreement.

More often than not the response is - "My agent had a crappy site and yours is much better".

How do you really know if they are actually working with that agent or not? Buyers are liars and they say all kinds of things for all kinds of wacky reasons. Since he approached you and you didn't solicit him, I say work it and potentially turn him into a client. Make him sign a buyer's exclusive first.

If he's working with an agent, I'd ask him to contact his agent for listings/alerts. He can also set up the same thing with one of the "those" sites. But he shouldn't be getting info from us if he's working with someone else.
