Laura Coleman The laws for dual agency and dual representation varies from State to State. In my State it is legal as long as it is fully disclosed to all parties and there is written concent from all parties. In part the disclosure states:
". . .the foregoing dual agent or dual representative may not disclose to either client any information that has been given to the dual agent or representative by the other client within the confidence and trust of the brokerage relationship. . . . "
IMO although it is designated as dual agency or dual representation, the agent in effect becomes a facilator of the transaction.

It's too complex for a brief response in this forum; you should really look this up to get a thorough answer. True Dual Agency is illegal in some states, but you could get around that by limiting the scope of your representation. In states, where it is legal, it has to be with everyone's written consent.

To me, it is a lawsuit waiting to happen. You cannot represent the best interests of both sides. In my state, with consent of all parties, you can only be a messenger and assist with forms, performing ministerial acts for both sides. Neither client gets the benefit of true representation. I feel that only the agent wins in these deals, not the clients.
