Usually handled by the title company. Every state has different mechanic lien statutes. some more onerous than others for property owners who has a contractor who uses subcontractors!

The title company tracks those down, and for any construction that is done in the 6 months prior to closing they will require an affidavit from the seller and/or the contractor.
