Seller traditionally, but very negotiable and I often counter it in multiple offer scenarios as a listing agent...it's puts the seller on the hook for a can of worms in the owrst case scenario.

I would think that if it is a government requirement, the seller should have already complied when the house went on the market.

So I vote for the seller to pay.

Florida does not have anything like that.

Hi Nina -- typically the Seller pays for government requirements(you know I'm in So Cal too) but it's, of course, negotiable.   In a recent transaction representing a seller --- it was clearly noted in the mls and in all counter offers -- the seller would not be responsible for any retrofit requirements including the city of Los Angeles 9A report.

In commercial real estate (CA) when a gas station is sold and rebuilt as a shopping center, the buyer paid for soil remediation to EPA standards.  It was one of the aspects that was factored in as to whether the development made sense of or not, and the same with asbestos.

In residential, the seller usually took care of that.  A

We're a Buyer Beware state and everything is negotiable.  Typically the seller pays, but there is no requirement, certainly not by a state apparatus.

Retrofit?  Not familiar with that term.  As for inspections requested by the buyer (whether required or not) they were always negotiable.   In my experience in Central Washington state, the seller usually paid for the pest inspection and septic pumping and inspection if that applied.   The buyer paid for the home inspection... which could result in additional inspections and/or work orders.

Usually: smoke alarms and carbon monoxide devices, water heater bracing, low flash toilets and shower heads, etc.( depends also on county).  Seller does not have to pay( that's why it is an option in CA RPA 7B), but it is a custom that they usually agree to pay.

 Retrofitting what?  The fire sprinkler system?  This is an issue in Florida condos... but a condo association can vote to forego the retrofit, if a majority of the entire condo members don't want it.

Government? Not sure what that would be here in PHX?  As for retro-fitting that typically is negotiated out during inspection period and depending on how hot or cold the market determines who pays for what - IF - anything is done at all.

I'm next door in Ventura County, so we have everything you do with the exception of the seismic retrofit/water fixture compliance inspection.  Ours are smoke & CO detectors and water heater bracing/strapping.  That is almost always a seller expense, unless buying probate or from a conservator (then they're buyer expenses).

 

For CO/Smoke, most agents have a couple of the $10 stick up detectors in their cars during the appraisal.  In LA City, I've heard of agents having some shower heads in their cars for the water inspector.  Slap on an low flow ugly one and put the good one in the drawer, pass inspection and let the buyer know where the good one is.

We have some low flow water requirmements that are not enforced by anybody in Nor Cal.   Generally speaking it seems the seller should pay since it's their house...

The business owner (commercial) is required to pay the cost of such requirements here, Inna Ivchenko.  For residential sales - if the buyer is purchasing to retrofit, the onus is on the buyer, not the homeowner.

If it is on the home inspection it is totally negotiated in TN depending on the market. If it shows up on the appraisal, it is the seller.
