There was an escrow officer I did not like, drug of choice for all the old timers. She interfered in things that weren't her business, played favorites. I tried to be cool, but something was off about her. Finally, after enough was enough, I went over her head to the regional and got one transaction moved to a different branch with a different escrow officer. She was livid.

Fast forward about a year. She went down for embezzlement and fraud, ended up doing time.

Sometimes you can't avoid dealing with an escrow company that sucks, and have to take one for the team. When you have the power, though, control that aspect of the transaction and it will make life easier for everybody.

I was hired to protect them, That protection may include changing title companies or detailing the risk/danger that lies ahead.

I would not.  I do not have any issues escalating or filing complaints which 99% of the time takes care of the problem.

We don't use Escrow companies here, our clients use laywers for their real estate transactions.  It is up to the client to select their own attorney to handle it... I don't get involved in that part of the transaction.

That's a hard question for me to answer, Paul, because we use attorneys in NC and SC and I always have input into whom we will use for settlement. And sellers and buyers do not need to use the same settlement attorney. I have "fired" attorneys who did not perform and never used them again.

I like local real estate lenders, title companies, insurance agents or home town attorney based deals. I try very hard to avoid using gypsy, no sticks and bricks in our small town economy. They come carrying home made pies, anything to get the business. The further from our area lenders also get poor turn around with appraisal requests due a shortage of Maine real estate appraisers. Push local. Or there won't be a small Maine town.

No, but there are agents and companies known for being unethical (heck, they did time in prison for fraud and are back selling real estate again) and those I wouldn't work with.  A bad escrow company, I wouldn't loose a deal over it, but I'd set the expectation bar really low and then ride them like a jockey rides a horse.

Probably not, but I would request to use another. IF that didn't work, i would absolutely stay on top of every detail to try to alleviate any potential problems up front.

 

If it was an ethics issue, I would let the other agent know why I would prefer to work with another suitable party instead.    Tough call.

In my title company business I have told realtor clients not to send me a buyer who is using a certain mortgage broker.  His deals never close on time and it is always someone else's fault, (according to him).  Often he blames one of my processors.

I would rather give up the business than hurt my reputation by being even remotely linked to him.

I neither work with escrow companies I loath nor lose the deal-not sure why you'd have to lose the deal? Typically I choose the escrow company as a listing agent and or counter for mine as a sales agent.
