Here in NH the buyer does not have to give the seller the inspection report. It Could be a privacy issue.  Most buyers will say they paid for it. A good listing agent already goes through a home when they list it. As a buyer agent, i want my own inspection, i would not trust anything from any one else.

I heard about that - it was announced at Keller Williams annual conference - which we did not attend.  More reading needed to think things through.  In AZ at least the contract stipulates that Buyers must share copies of the inspection reports with the Seller.

Privacy would be a concern for me as well, Silvia. It will change the dynamics of others who bring their buyers to this firm's agents.

I'm sure the other brokerages will encourage their buyers agents to encourage their buyers NOT to share inspection reports with anyone from that particular brokerage.

OR, they will have a new clause in the Contract that states that the seller is not permitted to share the transactional documents (including inspections) with anyone else. 

I'm curious what NAR has to say about this.

I know inspections here are the buyers. This makes me wonder about dual agency repercussions, initially. Then, I thought about how the known issues of a property would be available and if sellers would update the Property Disclosures. Our Board removed Property Disclosures for closed properties about five years ago. I hate it because it makes it tough to know what has affected a property in the past, now

      A group of real estate agents who have no legal relationship with a property owner, are going to release "previous" inspection reports on that property, to the general public.

     Lawyers are going to enjoy this.

This will be interesting to see, as in fact, inspection reports are the property of the buyer who paid for one... and it would require permission to release them. And frankly, I'm not sure what added value there is to having these inspection reports... too many variations on quality of inspectors and appraisers don't get into inspection issues when valuing a home.

This is obviously being suggested by someone who does not know real estate. Why would buyers release their inspections? How would that make for a better CRM? 

Agents pool their data now, it's the MLS or RPR!

An insoection is the opinion of the inspector and often incorrectl So sharing that brings up all kinds of issues. And, the franchise has your CRM if you leave and you, do not!

So a listing agent will have to go through the history of a house they are listing to see if there are any defects in a previous home inspection and verify whether these defects were remidied or risk not disclosing something they should have known. The same goes for a buyers agent.

Data sharing? I wonder what type of data... Inspection reports and such? I see..... Owned by thirds parties? But shareable? Swell, more lawsuits on the horizon - we'll be targets. Lets read the fine print in home inspection reports.... the report becomes moot when used by third parties.

I did see the KW article, but did not read it.... There's a lot of competition among the large national brand name franchisors and there are some ideas or gimmicks being floated around to do agent recruiting or retention as many agents are leaving the big names to create their own brokerages or join a team.

Arizona has seen the largest exodus of agents from the major brand name franchisors.

Interesting.

Sharing listings and reports (with consents) is okay, but I would not share prospect/buyer/seller contact info as it would be "stolen" most likely, or sold to other agents as leads.

Many agents never see their clients reports so I can see that sharing this information my not be in the best interest of clients and could result in problems later.

On inspections reports here in Austin inspectors write on the report that this inspection is not to be shared. I can't imagine who came up with this idea that is infringing on the rights of buyers (In Austin) who pay for the reports. Terrible idea!

I just returned from that conference. I'm not sure about that specific quote. I know there was mention of home inspectors who use particular software programs owned by third parties is basically sharing the data on that property with the owner of the software. The owner of the software is data mining. There was also mention of a company who owns a particular appraisal software who is also collecting data on homes. There are many 3rd party companies out there who are collecting data on homeowners. I'm guessing every Real Estate agent is using one or more of those companies not realizing it. It's a bit scary. KW is creating a platform which allows agents to own their data and prevents homeowners data from being "mined" or collected by third parties. There's so much more to it.

Ok, let's look at this.  You review 10 inspection reports from a variety of inspectors, some worth their weight in gold... some just came from a Tide Pod buffet.  The best you can hope for is "homes tend to have issues with X".  You have no idea if the issues are related to builder defects, homeowner use or what.  You also have no way of knowing if it's been repaired or not.

 

Now, as to the legality of someone else seeing the report the buyer paid for, I'm sure some shrewd agent will bring a class action lawsuit the first time this impacts them.

I cannot count how many inspection reports I have seen with inaccurate information on and now they want to share it with agents with no knowelege of the entire deal... this seems like a "smart" thing to do... and thats without even considering privavcy issues.... or that a large company tinks they have "rights" to my client base
