No way would I provide information like this to a FSBO when they are already fielding multiple offers except in a very broad range of value. And even that would be provided with tons of written disclaimers. They are not my client and I wouldn't want any future liability to arise from any advice I provided them. At this point they are better off accepting one of the offers or getting an appraisal done.

I've had requests like this from people already listed with another agent and I tell them they need to deal with their agent and not me.

go visit the home and do a cma.... give them a fair market value range.... and offer to do the deal for a flat fee....they still need agreements and inspections....

Tell them you can't help them if they aren't a client.  At that point, I would offer my services and the fee I charge.  If people can get free advice from us at that stage, why on earth would they ever hire us?

     Since you offered a CMA on your website, and no other real estate broker is involved (ethics), then you need to provide something.  Unless your state law would consider it Unauthorized Practice of Law, for getting involved in a transaction that you did not initiate.

Hands Off!  I do not represent that seller who is asking for help with offers in hand. 

I would explain that because I know they are a FSBO, and the information requested is needed to negotiate offers, my E&O insurance will not cover me, or them. 

In this situation, I would not offer my services for hire.

If they already have the free report, tell them that's all you can do since they are already listed.  If they want advise they'll need to sign a non-exclusive listing agreement and agree to pay you X amount.

Often I get calls from buyers that have selected their favorite home and now don't trust their agent, so they want me to answer their questions or "help" them further...

I would first of all gather as much information from them as I could.

I probably would do a CMA as promised, but provide a range that you feel comfortable with, do not get too specific. Make sure you use a disclaimer.

Avoid too much advice. You are not their agent, don't act like it.

Sign an Open Listing agreement for just the current offers on hand; negotiate a set fee or a reduced commission since you did not do anything to promote the property, if this is okay with your broker. Otherwise, since you offered a free CMA, you just have to provide it. Assume it did not specify anything about what the consumer wanted to do with it. If he didn't tell you he was a FSBO with offers, you'd just provide it, right? Do it, if the offers don't work out, he might list with you.

While I understand a lot of the responses, if I've offered the CMA, i would likely provide it. Worst case scenario I create a bit of good will and potentially a future referral from an 'overwhelmed' FSBO...

I would look up comparables in the MLS and provide them as I would any other person requesting information on line.  You never know ... they just might ask for you to take the listing.  This has happened to me in the past. The seller did not want to deal with the negotiations and paperwork ... so I listed and sold the property!  Follow Thru.

I try to make an appointment.  "I need to see the home to evaluate it's current market value". 

Once there, I can talk to them and see how lost they are. I would offer assistance for a fee, depending upon their needs and ability to proceed as they started.  Ideally, they sell to the best qualified buyer with a strong offer and I get paid too.

You could offer to help with the transaction for a fee, and a written contract. But I would be worried about liabilty in providing anything but a broad brush view of value. And they are not your client.

a. offer to review the multiple offers and have your lender "vet" or check and see which ones are real. Explain that the offers are only as good if a pro checks FOR A FEE 

b. give them a verbal range number which is high and say you would need to spend the time for a physical inspection to give them an exact number. Have a fee in mind for this Broker Price Opinion they want, say it costs $400 to write it out. They probably have a buyer who will hire an appraiser but the seller is worried they sold too cheap?

c. be nice, be kind, be smiling sweet but don't waste a great deal of time, they did FSBO because they don't value your time. Don't give advice.

d. tell them if offers don't work out you have a marketing plan but don't share the plan just be nice be kind and be smiling, and move on.

e. ask them how long a time frame they need to close?
