Why not? I post HOA docs in MLS attachments everytime I list a property. That way agents can pull them off of MLS and not bother me. These are publicly registered documents, in any event, so why keep them a secret? Maybe there's something in the documents that a prospective buyer would decide takes a specific condo off their possibilities list and that way the buyer is not wasting his/her time, his/her agent's time, seller's time to look at something they wouldn't buy because of something in the docs.

Sometimes if the docs aren't posted online, I will ask for them for a variety of reasons including:

  • If it's an investor buyer and we need to know owner-occupant requirements/rental cap
  • How many pets are allowed or if there is a size maximum
  • Fees
  • Assessments
  • Financials

Some buyers don't want to waste time touring if the complex doesn't meet their needs.

Absolutely! it is better to accept an offer from the buyer that is 100% sure about purchase decision over a buyer that may walk out on condo docs later.

Absolutely.  This is a huge issue in Florida.

      You can save time for both Buyer and Seller if the COA and relevant documents, including financial and legal obligations, are not going to be acceptable to Buyer.   

     Also, whatever Docs your seller or their agent has provided may not include everything pertinent to the COA.  Have an attorney or a title person make certain that your Buyer gets all documents during the contingency period.

Yes! There are plenty of reasons to review condo docs before considering the complex.
If there are deal breakers in the Covenants, why waste time going further?
Many of our HOAs have governing documents posted on their website.
I keep CCRs, By-laws and Architectural specs handy so that I don't have to request those documents and can make them available for you and your buyer in a heartbeat.
Our wonderful title companies usually have them handy digitally as well.
It's usually not a huge deal to grab them.

I agree with the majority here, having the condo docs available for any interested party is a good idea. If I were looking at condos, I think I would actually want to see them before I considered looking at the property to make sure that I could live with their rules/

That depends.  Although I prefer as much upfront disclosure as possible condo/HOA documents are typically not available in advance of the offer presentation in my area ---that's reality. If the owner knows certain rules or restrictions,  those are disclosed with the source of the information included. The "official" condo documents can take ten business days to be ready---absolutely ridiculous in my opinion.

No sense in going to view the property or any property in a complex/subdivision if they have restrictions a buyer is not willing to abide by those rules, regulations, and association fees. It also aids your seller in preventing unnecessary showings to buyers that are not willing or agreeable to buying the property.

Id say it would behoove an agent to get those docs upfront , and possibly saving all parties lots of time .
We have a lot of investors looking at condos, and nothing worse than seeing it, fits all the buyers needs, location etc, get offer submitted only to find out that it cant be rented for 2 years.
Or the HOA/COA restictions on type of vehicle, pets etc..

If they want to read all the bylaws etc before determining whether to view the condo or not then so be it.  Sometimes they want to learn about the restriction, how much reserves it has etc.  All I do is just email them.

IN the property description I will include pet restrictions, age restrictions, how the fees are distributed and lease/rental rules.  Recently read a pet restriction as 'cumultaive weight can not exceed 200 LBS.'

Now as an attachment in the MLS will be the Condo Docs and latest financial.  When a request comes in for any of this information, it a CLUE who is on the other side.

The question I ask is when is the buyer ENTITLED to this information? The agent for the buyer should be able to present the need for such information in a meaningful context.  Meanwhile I just don't get into busy work thing.

We strive to be the 'go to' person for certain subdivisions & get taken advantage of it every day. At least I do & makes me question what the hell the management company does.

I echo what Michael Jacobs  says. I share what the seller has disclosed, and a copy of the rules and regs if seller has available...but these are not the official docs until requested by escrow from the HOA during due diligence.

We provide all documents up-front, on-line if we have them available. We want buyers to make intelligent offers and not find reasons to back out after going into contract. Many properties in our market are being sold “as is”. In order to make that work, it is best to get pre-listing inspections, HOA docs and all seller disclosures and provide them to interested parties.

It would depend when they were requested.  Anything more than 30 days would not be current, and lawyers here would not accept that.. They would ask for a current copy..

I would ask the buyer why they want they want the docs. It may just be a question that a quick call to the management company can resolve. 

If not,  in my county, condo docs are recorded with the Clerk of Court so easy to access online. Our MLS also has a field for the name and phone number of the CAM or management company so questions can be directed to them.

Providing condo docs is a slippery slope since you need to be sure all amendments are included and that you also provide the Rules & Regulations and FAQ sheet (required in Florida).

But it is better to provide this info upfront rather than waste everyone's time.
