How did the seller feel about this?

If I was seller and an agent made an appt to allegedly preview/view the home and it became a high pressure why didn't you hire me tactic, I'd be 50 shades of annoyed that the agent was bothering me and that they didn't really have a buyer for my house when they made the appointment.

If your seller felt that way & if you have a good relationship, ask seller to email you stating date, time, what transpired.

THEN, forward it to the agent CC broker with a note from you that states:

"I trust this will not happen again."

Depending on how brazen it was I would tell her broker & then maybe move it along after that. There are plenty of agents think they 'own' the entire planet - that's just not so.

Wow. I've not experienced something like this. I definitely would speak to my broker for her guidance and follow it from there. Something tells me this person won't be in the business much longer anyway - I'm sure this is not her only time...

I'd also add to my listing package to advise potential sellers ahead of time that nonsense can happen...

We've got a Dirtbag Agent that works in our area that pulls this kind of crap. He tried to sour my relationship with a seller getting in her ear while I had an active listing. He makes false claims about his production. He steps all over other agent's toes. He's rude & condescending to women. He's just a downright nasty, a**hole Realtor.  Everyone in town knows.

I would definitely report her, Karen. This is clearly an ethics violation and I'm not so sure the 'same nationality' comment isn't a federal violation.

As drastically as our profession is changing, it's agents like this who need to be weeded out. We can't keep 'protecting' them by slapping their wrists and saying, 'Don't do that again.'

I would get pissed off initially.

But honestly, I am way too busy running my team, taking listings, negotiating offers, following up on deals, getting estimates to repairs my investor flips, putting out fires, designing marketing materials, prospecting new leads, doing cma's, attending meetings and going to closings to worry about what some loser agent is saying to one of my sellers.

In a perfect world I would punch them in the nose. But the police are hear to protect these slime balls and I would be the one in trouble. So I just beat them in business. And most of the time I do.

I've had similar things happen.  I called the agent and gave them a choice:

1. Write a letter of apology to the seller acknowledging your wrong-doings. 

OR

2. We will both file a complaint. 

Not only did one agent write the letter, he called the seller begging for forgiveness.

There's no consequence to what she did, other than upset you right now.  If you report her to the ethics committee, she is more likely to change.  It is a PITA to go through the effort, but this will be a rinse and repeat for her unless she suffers consequences.

Valid market research does include finding out why others are selected over you,

This agent's ego and lack of common sense blinded her to the reality you must have a surrogate do this research on your behalf.

I'd make it a teachable moment and a clear 'you own me one' event. If not humbled I'd throw such agent under the bus. Not by reporting via the system but by using this example as a poster child for a desperate agent who'll do ANYTHING. She would know it's her, but no one else would. 

Which process, reporting to the board or public accountability is most likely to change behavior?

I usually give people the benefit of the doubt the first time as there are a lot of new agents out there and many have questionable education and supervision. However, it sounds so over the top that at a minimum I would ask for the supervising Broker to be made aware. It may just take a good discussion with her on the Code of Ethics, assuming she is a Realtor.

Competitive agents talk to clients all the time. Soliciting a listing is a violation of the code of ethics. File an official complaint. You'll need a affidavit from your client btw.

And/or perhaps write a letter about the event and the violation - make it a an official notice, and copy the MLS, Association(s), the brokers, and the commissioner or head of your Dept of Real Estate (they won't do anything, but they will keep the letter on record, and it's a tad intimidating for the agent in question).
