OMG, Lynnea! What is going on in Oregon?

You know, I think you'll have a lot of independent agents who operate on their own, under their own business license. A FAR worse scenario for buyers & sellers. There's no one to hold a lot of the independents accountable that we have now. I can't imagine a state full of them!

This has been going through the courts in CA for a while now.  Technically, we do not pass the federal tests.  The main test we fail is operating without oversight... which in CA a Broker is required by law to supervise their agents.

 

My thoughts on this are as follows:

  1. It will likely come to pass as the states and federal government want to make sure everyone is taxed.
  2. Brokerages will need to layoff the majority of their workforce, because most are not capable of producing enough business to justify the cost of carrying them (insurance, taxes, HR, admin, salary, benefits,...)
  3. Brokers will still be allowed to be independent contractors because we are the only ones (in CA) legally allowed to list and sell properties on our own.
  4. There will be an increase in people with Brokers licenses and independent companies.
  5. Teams and agents with buyers agents, etc. will get a rude wake-up call
  6. Eventually most (80-90%) of agents will be forced out of the business and the independent and agents that produce at least $60k/yr in commissions to the BROKER will be the only ones left.

This will also have an impact on new agents as they don't have a track record and who will want to take them on, unless in an apprenticeship role?

If brokers actually did their job, this would be a non-issue.

Such a loss of IC status would create great disruption in the real estate brokerage business model.

Making them PAY would compel brokerages to look after their investment. One would be extremely limited in their thinking to believe the only compensation model available for brokers is hourly. 

But, this is what happens when we don't build that wall. The crazies leave California and take their craziness to Oregon.

NC now charges a sales tax on service labor. They tried to include us agents commission but that part failed, for now. Sellers would have had to pay a sales tax on our commission.

Yes here in NH too and for the same reasons. They masdate that an IC can not be given a schedule, work can not be mandatory outside the scope. This is what happens when voters vote without knowing who they are voting for. You get more regulation and more taxes. All that hurt the people that work the hardest
