I've sold property before that I worked SO hard making the landscaping just beautiful and had the buyers tear it out after they move in. While it hurts to see the change, it's their property to do what they want with it.

It sounds as though the buyer would have said whatever he needed to say in order to purchase that particular property. I'm sure the seller will be disappointed when they find out, and I'm thinking they'll find out some day from a friend, neighbor, or from reading something online. I wouldn't tell them. Why make them miserable?

Case closed!  I had a friend who wanted to sell their 5 acre property to someone who would NOT develop and maintain the country feel. He was willing to sell at a discount to accomplish that.  I told him they will tell him whatever he wants to hear then do whatever they want because they will own the property and there won't be a thing he can do about it.

What is your ongoing relationship with the seller? It may be worthwhile to convey the information to the seller just 'cause. Seller may find out from another source and be upset with you. Let the seller find out from you. Let him vent. Nothing you could do to prevent the new owner from putting the property to its "highest and best" use.

Unless the property is deeded with specific WRITTEN instructions as to its use, the former owner is only wishful-thinking. The investor acted immorally, as in lied, but did not break any laws from what I gather. Agent should let it go as nothing would be gained by upsetting the selller.

I don't think that Abner's wishes could be enforced. It was just a hopeful on his part. The new owner can do whatever he wants with the land if there were no deed restrictions.

This seems to happen alot with older folks. They want the new owners to conform when legally they just don't have to.

The water is already over the dam, so no real benefit in telling the previous owner.  If an owner is so conscious of what the new buyer do, they should never drive by the property after they sell it.

My first thought was this was a discriminatory comment and would ignore it. Seller could always add a deed restriction if he wanted to ensure only one house of a certain style, etc...

If you tell them, they could get mad at you.  Best to leave it be.  Afterall, they don't have any control over what the new owner does with the land.  Plus, realistically, that seller's wishes were discriminatory to begin with.
