I had a buyer who had gotten through the entire Due Diligence and the sellers decided that they didn't want to sell!  My clients had spent a good deal of money in the way of a deposit, appraisal, inspections, Title/attorney and survey fees.  

I had an attorney write a letter to the sellers and they reimbursed my buyers for all expenses, including the attorney fee for his intervention.

As it turned out, the buyers wound up with a better home and to this day, are as happy as two peas in a pod in home #2!!

Buyer sends out a counter offer then get a better offer. Wants to take the better offer, I cancel the counter offer. Young, cocky buyer's agent claims "we had a deal!". Had to explain to him that there is no deal until the paper work is done. Sorry. His agent calls me threating to sue. Told him we didn't have a completed deal, his agent shouldn't have taken so long to get the counter offer back to me. Never heard from him again.

An agent I know is taking her Seller to small claims court right now. Judge Judy show contacted the Seller. They offer to pay the claim $1800, $500 show up for half day and free hair and makeup. I think the show is going to damage both parties reputation; but, what do you think anonymous?

I think most contract disputes come from one party drafting language that is unclear or incomplete. Real Estate agents have to be very careful not to "practice law". If you are in a state where the agent has the ability to write a contract they should avoid modifying contract language. If it is a state that uses attorneys, leave the language to the attorney.
