In Florida, if you have a single agent relationship with the seller, you have no brokerage relationship with the buyer.  The reverse is true as well.

Even with no brokerage relationship, you still have to account for all funds, deal honesty and fairly, and disclose all known facts that materially affect the value of the property.

  Karen Climer has the answer.  When you are Single Agent for a party, you need to extinguish "the presumption of transaction brokerage" that the other party may have. 

     The Statutes require that we do that in writing, on the State-mandated form in F.S. 475.278

 

                           NO BROKERAGE RELATIONSHIP NOTICE

    FLORIDA LAW REQUIRES THAT REAL ESTATE LICENSEES WHO HAVE NO BROKERAGE RELATIONSHIP WITH A POTENTIAL SELLER OR BUYER DISCLOSE THEIR DUTIES TO SELLERS AND BUYERS.

Another scenario, where I did not wish to represent either party in any capacity (conflict of interests):

My relative was selling property to another relative.  He wanted a written contract.   

I gave the No Brokerage Relationship Notice to both parties (and had them sign it).  Then I wrote the contract, and took it to a real estate attorney.  The lawyer drafted the Deed, disbursed the funds, etc.  Done deal.

in Georgia we have an "authorization to show unlisted property" that we use when a buyer client wants to see unlisted property.  Sometimes the seller will agree to pay us, other times the buyer does. However I've never heard of a no brokerage "listing agreement", no brokerage agreement, no listing in my state.

Here everything is between the brokerage and the client, agents are agents of the brokerage, and the brokerage is an agent of the client.

Without the brokerage we are not allowed to operate.

We do not have that in Connecticut. The "no brokerage" concept sounds a bit confusing or even deceptive as no agent can operate on his or her own; needs to work under a broker, even in Florida, isn't that correct?
