Depends on many things:

How severe is the violation?

Is this a pattern of behavior on the part of the agent or a simple mistake?

Do I know the agent and would I expect them to be receptive or defensive?

Our MLS does not out the whistleblower which is a change in recent years that I like.

Our DRE requires a formal complaint naming the complainant. That discourages a lot of complaints who don't want to go to the mattresses with another agent and deal with possible retaliation.

A number of our consent orders involve unlicensed activity and PM violations. In your example I might bring it to broker's attention if I felt the broker was going to be helpful.

Otherwise drop a dime to the DRE.

Some people I might let Karma take care of them LOL

I'm the president of the MLS so if it's a MLS violation I contact the individual first and then if it's not corrected in a few days I contact the broker.

Outside of my MLS I mostly ignore it because I just don't have time to be the police for the GREC and I happen to know they are about 3 years behind on investigations and that with the pittiful salary they pay that's not likely to change anytime soon.

I have on blatant violations Peter Mohylsky, Beach Broker but it's only been a couple. In regards to PM North Dakota has no restrictions on who can be a property manager.

I generally tell my broker (also wife) and let her handle it.  In my office it's handled with a quickness, outside of my office it's handled and outside the MLS it's sometimes just a head shake because investigations are lagging years behind in our state.

I turn in where the sales are reported as sold in 2 or 3 categories to the MLS. If there are typos, corrections to directions, or other issues, I call the agent. If they don't fix it, I call the MLS.

Per your example AZ goes after what they consider -not property managers. It's  matter of time before they get found out.  Would I report them? Probably not as honestly I never really ran into this as it was outside my scope of business.

It so depends. While living in Florida there was a nun who assisted parishioners buy and sell real estate. Some reported her to the state who denied to pursue it. She actually did a great job and life went on. And no NAR, state or local dues.

Generally I try to keep my eyes on my own paper, MLS  violations are monitored at the Board level and fixed or fined. Have not had a license violation that affected me but seeing the violations in the quarterly ODRE  newsletter is an interesting read.

It really depends on the situation.

Here we are allowed to have unlicensed property managers, they are however limited in what they can do without a license.

   Practicing real estate without a license in Florida is a 3rd degree felony.   

     The question for Peter's "property manager"... is this person operating as a broker or sales associate?  If "yes", and they have no license, he or she might find themself up the proverbial creek.

 

   Here is the Florida Statute:

  475.42 Violations and penalties.— (1) VIOLATIONS.— (a) A person may not operate as a broker or sales associate without being the holder of a valid and current active license therefor. Any person who violates this paragraph commits a felony of the third degree

 

Now, do I file a formal complaint with DBPR/FREC?  Only if I, or a client, or customer, or friend is being adversely affected by this "Property Manager". 

If they are operating outside the Law, it's only a matter of time before DBPR finds out; they will ask the FDLE to investigate.

It depends on the violation and my mood. I typically won't report someone unless it's harmful. I might reach out to the agent if I see an error. Sometimes I just let it slide because I'm not in the mood to deal with it. So, all of the above I guess.

I've stopped, unless it's egregious and even then...

In your example of unlicensed PM, we have the same laws.  I have turned in MANY people doing Air B&B Arbitrage, even some out of state companies, and the DRE has sent me back many a "thank you but essentially we don't care" letter.

I have zero faith in the DRE to find licensing violations.  I gave them someone using an unlicensed assistant to prospect who crossed heavily into licensed activities AND targetted an active listing.  The DRE said "we can't find anything."  RAY CHARLES AND STEVIE WONDER could have found a violation with the package I gave the DRE.

I used to contact the agent first, if not corrected within three days, I would report to MLS. Most of the time, the correction was not made in any circumstances.  Very discouraging, so no longer I make the call. No my monkeys or my circus anymore.
