The answer is, ask your lawyer? When a home is being sold through a trust, the heirs of the estate need to be informed. If there are any objections they need a chance to express their concerns.  It does not mean that the home can not be sold, just that whatever the objection is needs to be dealt with, sometimes through court action. There heirs can agree to to forgo the 45 day waiting period for the Notice of proposed action by singing off before the home is sold. So, if you are selling a home in trust be sure and ask your lawyer if the waiting period can be waived before the sale of the house so that the escrow can close in less time.  You don't want to sign an offer with a 30 day close and find out there needs to be a 45 day waiting period. Deaths in families are always hard. They can bring out both the best and worst in a family. There is often a combination of sorrow and a bubbling to the surface of many past, and normal family rivalries and childhood issues. Every estate must have an executor and this executor can be anyone the owner of the estate appoints if the estate has been put in trust. If there is no trust but there is a will and the will names an executor that person must be affirmed by the probate court.  If there is no will the probate court will asign a personal representative. As a realtor who has been fortunate enough to list many homes in trusts and probates I have found that the ones that go the smoothest are those where a trust department at a bank has been named the executor.   WHY WORK SO HARD ON AN ATHERTON LISTING THAT WILL PROBABLY BE TORN DOWN?     Happy Mother’s Day! I hope everyone is treating their mothers especially nice today.  A childhood friend of mine posted a picture of his 96 year old mother on Facebook.  She looks old, but lively.  No reason not to put makeup on and dress up this vibrant woman.   The picture reminded me of my soon to be on the market new listing in Atherton.  While the house is not 96 years old, rather a rancher from the 60’s, it has been recently neglected.  The owner passed away after not living in the house for several years, and the estate is selling the home , which is on a very neglected one acre.   The pool is green with a broken filter, there are abandoned cars on the lot, the landscaping is compl...

Memories can be housed in stuff, especially as people gets older and they find that objects are needed to jog their memory.  The problem is that very often when it is time to leave the place that has been home for 30, 40, or 50 years, there is wall to wall stuff. "Have prices dropped since January 2009 in Atherton?" Thus started the question from an accountant working on behalf of one of her clients. I'm happy to help other professionals gather the information their clients need, and did a bit of research for her. Pulling information from our MLS for the part of Atherton in question for the last two years showed the following: Interesting--there has been virtually no change; in fact, the median sales price was exactly the same both years--$3,650,000.00 Next, I prepared a comparative market analysis for homes in the area of similar square footage, active listings, pending sales and solds since 2010. Normally, homeowners in Atherton don't want a 15 year fixed rate because the payments are too high. Now there is a twist on a 15 year fixed rate that can keep your payment low! This loan has a 40 year term. Initially it is a 15 year fixed rate. During the 15 year fixed rate term, the payments are interest-only. Because the payments are interest-only, the payment is a lot lower than an amortized 15 year fixed rate.  Here's the neat part - if you pay principal during the 15 year fixed rate term, the payment decreases because the payment is based on the reduced balance! After the 15 year fixed rate term expires, the rate adjusts once. The rate is determined by adding .5% to the Fannie May 60 day rate.  I am amazed at what has happened to this sleepy residential "village" it has never been an inexpensive place to live but with the prices going up like they are I often wonder what is going to happen in the next ten years or so. With the average selling price in Atherton well above the three million dollar mark and Menlo Park not far behind - where are the service providers going to live? Will this area eventually turn into a utopia of sorts for the chosen few that can afford it - who will serve them? Do you think the service folks are going to commute an hour or two to cut lawns, and clean homes? Let me know your thoughts...
