I don't know about you but I am coming across an increasing number of homeowners who believe that by filing a Chapter 13 or Chapter 7 Bankruptcy will stop their foreclosure!  I have spoken to many homeowners who have wasted thousands of dollars that they don't have on filing for bankruptcy in the hope that their foreclosure will go away.  It baffles me when I ask a homeowner if they are filing simply as a stall tactic... for most only for 30-60 days and that if they miss a payment do they realise that the bank will file for relief from stay?   When I ask these questions I get a response that is of horror that their foreclosure won't be stopped or cancelled if they file and default or the bankruptcy is dismissed...  is the bankruptcy attorney not telling them something or they just don't...
