. You have all heard about the fiscal cliff, tax increases and have wondered how badly will impact you. Depending on how much you earn the answer could be a lot. Buying a home WILL save you money in 2013 for three simple reasons. 1) Gains in depreciated value. St Cloud Florida homes and Kissimmee Florida Homes for sale, lost between 40-50% of their previous high value when the real estate market crashed. For Home Buyers looking to capitalize on value, these homes are now very affordable and well priced. 2) Mortgage Interest Deductions. Mortgage rates are expected to remain low throughout 2013. However, even under the revised tax increases the Home Mort5gage Interest Loan deduction can put thousands of dollars back into your pocket. This applies to second homes as well. 3) Property Taxes...

Hi folks. Have you ever looked at someone else's success and thought how "lucky" they are? Or, made a comment about a Blogger on ActiveRain, about how their posts are always featured and it must be because "they know the right people" or they are featured because they are "popular"? Did you know, successful people rarely, if ever, have thoughts like these? Successful people have a strong work ethic and have spent many years honing their craft to achieve "overnight success". Successful REALTORS® have spent many years prospecting and studying market conditions to be able to get "lucky" and be in the right place at the right time. "Popular" Bloggers on ActiveRain have also put in the time, done the research and studied the market (AR) in order to become "popular" and get into the right "c...

Pedestrian Tales From the Middle of the Road, #41 Pedestrian Tales From the Middle of the Road, #41 Well, the hits just keep on comin'...or rather, the stories of folks that keep getting hit keep on comin'. I don't know about you, but if I had to compile a list of the top 3 or 4 ways I could leave this world, walking out into the road and into the path of semi truck wouldn't even make my list. The gruesome incident described in the following news story falls under the less-than-watchful eyes of Osceola County Sheriff Bob Hansell and new Kissimmee Police Chief Jefferson "Lee" Massie. May God bless the family of this lady who inexplicably walked out into harm's way- and may He bless and provide comfort and counsel to this innocent truck driver as the years pass by. Hi folks. This article is a response to,"How to Take Advantage of Struggling Real Estate Agents, as a Seller". I was going to write a post to address many of the comments about "I'll show any listing regardless of commission" and "I always put my client's interest first" but then I realized I had already written that post. So here it is. ************************************************************ Are you being honest with yourself? First posted 2-24-2008 Here's a little scenario for you. "Hi Broker Bryant. We saw your ad in the paper and would like to list our property with you." Excellent!! I'll be right over. So, I head over and give them my little spiel and they want to list with me.   OK folks sign here and here and I will get your property up and running on the market. "But Broke...

Because it's to THEIR advantage to do so! We need to be able to explain this to them.Hopefully this will help. I received this email from a potential buyer: You are right Bryant, I should not work with 2 Realtors at the same time and got a bit excited after reading your blog. It occurred to me you are more than an average Realtor (broker/listed agent) and may get a few properties ahead of everyone else and sometimes yet to be listed in MLS. There are few foreclosure specialists in Chicago area that work on fee based service. Please don't think otherwise but appreciate if you can clarify the following:   If you are like anyone else, what advantage does a buyer have in hiring you to acquire an REO? What is this retainer for? I can see some buyer advantage in short sales but for REOs I do...

Hi Folks. Here's a comment that I received from an employee of Bank of America. I think it sums up some of the frustration that we are all going through. I will keep the comment anonymous and it has been edited for grammar. Here goes: "I have sat here and read through all of these messages and I am at a loss for words. I currently work as a supervisor in the short sale department for Bank of America. And YES I hate my job. I hate having to get on the phone with these homeowners and agents and explain to them that I do not have the authority to submit a same day postponement for a foreclosure. Nor do I have any more contact with their negotiator than they do. My first week on this job had me in tears. I was on the phone with an Attorney who was trying to stop a foreclosure sale and in th...

If you handle Short Sales for a living then I am sure you have had this happen a time or two.  As frustrating as it is the lender has the right to protect their collateral. Don’t believe it? Read the mortgage that was signed at closing. It probably has a clause in it like this: Protection of Lender’s Interest in the Property and Rights Under This Security Instrument. Lender may do and pay for whatever is reasonable or appropriate to protect Lender’s interest in the Property and rights under this Security Instrument, including protecting and/or assessing the value of the Property, and securing and/or repairing the Property . . . Securing the Property includes, but is not limited to, entering the Property to make repairs, change locks, replace or board up doors and windows, drain water f...

Hi Bryant,   I am looking for techniques for obtaining Waivers of Deficiencies.  I noticed that you have commented on this issue in the CDPE forums.   I recently listened to an interview and from what I can recall, the silver bullet was to put a rider on the purchase and sale contract which allows the seller the option to cancel the contract in the event that a Waiver of Deficiency can not be obtained.     My first thought was this was pointless, as the seller's lender is not a party to the sales contract.  He went on to explain, however, that the rider serves as an effective tool with which to threaten the lender during the negotiation process, and that he had a lot of success with the technique. Any thoughts on this technique?  Any other effective techniques to obtain a waiver? My tho...

Hi folks. One of my passions is helping other agents with their short sales. Everyday I spend time answering questions on Short Sale Superstars and other forums I participate on. One of the questions I frequently see is from agents wanting lender contacts so they can have a foreclosure stopped or postponed. My standard response is that the borrower needs to speak with an Attorney and they need to do it ASAP. It is not our job, as agents, to get involved with stopping foreclosures. Last I checked our licenses are for selling real estate not practicing law. Foreclosure defense is a legal issue not a real estate issue. Usually the response I get when I answer like this is “Well I’m just trying to help these people out”. No. You. Are. Not. You are harming them by trying to do something you ...
