There was a recent consumer post on Trulia where a buyer had been waiting since October to get lender approval on their short sale, only to be told this week that the seller had backed out!  Seems the seller was able to do a successful loan modification with the lender that lowered their payment and they didn't have to move after all!  Well, good for the seller; bad for the buyer.  The buyer's agent wanted the buyers to sign a release and give them back their earnest money, but the buyer wasn't so sure - I think he really thought something fishy was going on. As evidenced by the varying responses from Real Estate Agents all over the county, the law is very different in every state.  My response to those buyers was to seek the advice of an attorney - this is a way too legally complicated... 02/02/2011

"Trade Plan Available" means the seller might be interested in buying your home, if you will buy their home.  Sometimes, the listing broker may buy your home instead of the seller; or the broker may be representing a builder who would be interested in buying your home if you bought one of their homes.  Although the term "trade plan" is used, it's not actually a trade.  You buy their house and they buy yours - 2 closings, 2 settlement statements.  As you might expect, the seller who is taking your home in on "trade" will want to buy it at a discounted rate.  They will most likely resale your house, so they need a cushion to cover carrying costs until it sells.  KY Real Estate License Law requires that any time a "trade plan" is advertised, the real estate licensee must disclose the cond... 01/26/2011

Every year, NAR does their annual Home Buyers and Sellers Report. MYTH:  "As a buyer, I only have enough money to pay my downpayment and closing costs.  If I see a FSBO I am interested in, I won't be able to have my agent represent me because I will not have enough money to pay them too."
