Second Best March on Record April 5, 2011 - Greater Toronto REALTORS® reported 9,262 transactions through the TorontoMLS® system in March 2011, representing the second best March result on record. The number of transactions was 11 per cent lower than the record result reported in March 2010. "The strong home sales reported in March and throughout the first quarter of 2011 have been based on a solid affordability picture and improving economic conditions in the GTA and country-wide," said Toronto Real Estate Board (TREB) President Bill Johnston.  The average selling price for March 2011 was up five per cent year-over-year to $456,147. The strongest average annual price growth was reported for condominium apartments and semi-detached houses, at approximately seven per cent for both home t...

Mortgage Rates are Rising Three major banks, Royal Bank, Bank of Montreal and TD Canada Trust are raising their fixed rate mortgages today. For those who wish to ensure "peace of mind" in the buying process, this will raise the price of a property. If the trend extends to variable rates, and across the board to other institutions, this could have a negative effect on the Spring market. If you are planning to purchase then you should lock-in a mortgage rate today. If the rate goes up before closing you are protected. If the rate goes down, then you get the benefit of the lower rate. If you would like a referral to a mortgage broker, then please call me at 905-796-8888. The Negligence Act and the Real Estate Transaction  Ontario Real Estate Source By Brian Madigan LL.B. While many would wonder what the Negligence Act has to do with a real estate transaction, let's have a look at a recent case. A purchaser wanted to acquire a piece of commercial property. Obviously, for zoning purposes, in order to carry on business it needed a certain number of parking spots. There was "parking", it was just not situate on the lands being purchased as part of the deal. The entire issue fell through the cracks. The listing agent missed it. The selling agent missed it. The buyer's lawyer missed it. The Judge appreciated that the correct information was indeed contained in the seller's file. So, the Judge applied the law set forth in the Negligence Act in order to apport...

Earth Hour in Toronto was a Bust Ontario Real Estate Source  By Brian Madigan LL.B. You would think that with all the energy conservation talk these days, that something like Earth Hour would be a remarkable success. Well, not in Toronto. It started two years ago, an realized savings of 15% in 2009, that dropped last year to 10%, and it dropped in half this year to 5% savings. Some Toronto homes were photographed during Earth Hour, and they appeared to be quite illuminated. They included the house of the former Mayor, the present Provincial Energy Minister, and (this is very, very difficult to believe) the President of Earth Day Canada. So, this now looks like a complete failure. No one cares! The politicians and the political lobbyists don't even bother with appearances. Brian Madigan ...

Historical Development of Fee Simple Ownership   Ontario Real Estate Source By Brian Madigan LL.B.It's actually quite difficult to understand the concept of fee simple ownership when it comes to real property without looking at some of the history. We have to go back to England in the pre-feudal days. That would be 1065 and earlier. At that time, there really was no particular concept of private property. People definitely farmed the lands, but their rights were not well-established or well-recognized. Some contemporary historians might argue with this point. In 1066, William arrived from Normandy and defeated King Harold in the Battle of Hastings. Crossing the English Channel was difficult and William really didn't want to spend all his time with the barbarians. People in ancient times ...

Good Title and Better Title Ontario Real Estate Source By Brian Madigan LL.B.The traditional definition of good title in law, is a title without any qualifications, exceptions or explanations. A solicitor's opinion on title would point out any matters that were relevant to the issue of ownership. Such an opinion might read as follows: "you have a good and free, marketable title in fee simple, subject only to a first mortgage in favour of ABC Financial securing the principal sum of $ 100,000.00 together with interest at a rate of 5 and ½ % per annum, calculated semi-annually and not in advance....".You will notice that there are four distinct elements to the opinion. First, the title is "good". That means that the conveyances from the previous owners of the property have been correctly ...

Maintain Good Financial Records Ontario Real Estate Source By Brian Madigan LL.B.If you are in business you should keep good financial records. It just makes sense, but so many small businesses neglect this tedious and somewhat time-consuming task. Careful records take time. And, if you don't really have the time yourself then you should retain a bookkeeper and an accountant. Why? It will simply pay big dividends in the future. I'm not really talking about all the tax deductions that you don't miss because you have proper receipts, or even the warranty claims that you can present because (again) you have receipts. What I'm talking about is much more significant. It's the sale of the business, the accumulated wealth of your lifetime of work. Is there any value to it? What is your business...

Waterfront Property: Do You Own it? Ontario Real Estate Source   By Brian Madigan LL.B.If you are looking at waterfront property, you really want to know where your property ends and the lake begins. You definitely don't want a "gap".So, where's the line?First of all, you have to begin with the water. Let's assume that the body of water is sufficiently large that it is considered to be a navigable water. That basically means that it can accommodate boats, even very small boats. Obviously, this will include lakes, and numerous rivers, but certainly not all of the tributaries.Second, you will have to figure out where the body of water ends. A larger lake or bay or navigable river will have fluctuations in terms of the level of water within it. However, the boundary is clearly defined. It...

Condominiums From Ancient Rome Ontario Real Estate Source By Brian Madigan LL.B.As just about everyone knows condominiums had their origins in ancient Rome. In fact, you can find that type of reference on just about one half of the brochures for new condominium developers. So, I suppose the question is: is this true? Did condominiums come from ancient Rome? Well, perhaps it's half true. The word "condominium" is a Latin word. However, it is like the word "webominium" which means that you own a small part of a larger website. Now, when it comes to the Romans they didn't really have webominiums or for that matter condominiums either.Since so many people simply KNOW that it's true, why do I say otherwise? In 1961, Charles Ramsey commented on new trends in Co-Op's, and he wrote the following...

Ahhh, the hint of Spring is in the air.... the buds are ready to burst .... and of course, buying your new home.  Nothing is more exciting than buying your new home.... except maybe falling or being in love. Buying a home is a very emotional event... and can be very stressful ...  and in the excitment of the process, its all too easy to forget the additional costs involved in any transaction of buying a home. Here are just a few of the costs involved you need to know about, so you can budget for them. House Inspection This is an absolute must have, for both re-sale and newer homes.  Ask your agent to insert that condition in your offer. One of my pet peeves in real estate is when I send out a request to the agent who showed my property asking for feedback on the showing AND THEY DON'T RESPOND.  There are only 5 questions on the survey and it is a simple process, just click on a radio button from a multiple choice question... Simple, and takes about 20 seconds tops to complete.  Then click the send button back to me. I know there are several conflicting viewpoints on this issue.... but I feel it is important to respond.  Whenever I get a request, whether by email or a page to call the agent with feedback... I always do so, whether it is positive or negative feedback... I feel it is important for the seller to know how other agents, and perspective Buyers view their home.  I provide both positive and negative feedback if...

We had a very good "meet-up" yesterday at our office, and invited all our agents, and even outside agents to attend for discussion around our Espressor bar.. not a meeting or classroom, but rather a sharing of information about this topic.  Lots of ideas on the most effective ways of using a QR code, and how agents are utilitizing this latest technological tool. One thing for certain... all these new devices... tablets, i-phones, Androids, Blackberrys and such, and social media.... are not going away any time soon... so you had better learn how to use them to your advantage. You can have your QR code "point" to any website you choose..  Some agents are using them to point directly to their websites...others are having them point directly to a particular listing dislayed on the "For Sale...
