Can a relationship between a Broker and Client Exist without Written Agreement?   The answer to this question is YES in the state of Texas you can have a relationship between Broker and client without a written agreement. However a Broker cannot sue for a commission unless there is a written agreement signed by the party agreeing to pay the commission so my advice is to make sure agreements are in writing signed and dated. In Texas dual agency is not accepted and in this case it becomes an Intermediary relationship if allowed by the Brokerage where the Broker has a broker-client relationship both with the seller and buyer must have a written consent from the clients stating who pays the Broker. Austin Market Update November 21, 2014 for the Austin Multiple Listings Areas Active listings increased in October 2014 by 11 percent year-over-year to 6,170 listings and new listings jumped 11 percent during the same time frame to 2,850 listings. Single-family home listings over the last few months are having a positive effect on pending sales, which jumped nine percent year-over-year in October 2014 to 2,255 pending single-family home sales.     Austin area inventory also continued to benefit from more listings entering the market, increasing 0.2 months year-over-year to 2.7 months in October 2014.
