Texas is a Community Property State Community Property may be defined as all property acquired by either spouse during marriage. EXCEPT that which is the separate property of either.  CONFUSED ?? Separate property may be defined as "All property owned or claimed by either spouse before marriage and also that acquired afterward by gift, devise or descent." Okay, exactly what constitutes separate property is a question of fact because property acquired during marriage is generally presumed to be Community Property. Therefore, for the purpose of insuring title, the burden of proof is on the spouse who claims the property to be separate in nature. THEREFORE, any buyer seeking to purchase property in Texas by financing part of the payment for the property, must include the spouse on the Deed...

An inspirational Poem to start your day.....   Don't Quit When things go wrong as they sometimes will, When the road you're trudging seems all up hill, When the funds are low and the debts are high And you want to smile, but you have to sigh, When care is pressing you down a bit, Rest if you must, but don't you quit. Life is queer with its twists and turns, As every one of us sometimes learns, And many a failure turns about When he might have won had he stuck it out; Don't give up though the pace seems slow-- You may succeed with another blow, Success is failure turned inside out-- The silver tint of the clouds of doubt, And you never can tell how close you are, It may be near when it seems so far; So stick to the fight when you're hardest hit-- It's when things seem worst that you must...

Now that you have changed your clock for Daylight Savings, it's time to do something even more important....change the batteries in your smoke detectors.  Each year we "Spring" Forward by moving our clocks ahead one hour and then we "Fall" Back by moving our clocks back one hour.  When you do this it is advisable to change out the batteries in your home smoke detectors too.  This will ensure that you have fresh batteries twice per year and that your smoke detectors will be ready to function when they are needed most. "Each year nearly 3,600 Americans die and 18,600 are injured as a result of residential fires," says Wylie, Texas Assistant Fire Chief Noe Flores.  "There is time to escape most house fires with an early warning from smoke detectors.  They are effective, reliable, and inexp...

I have been asked this question over and over since last fall: So how is the market? Is it coming back? Are you selling? I also have heard agents say "I'm waiting for the market to come back" to build my business. I call these the fear questions. If you listen to what associates and clients are saying , you will hear fear. It doesn't matter when the market comes back, real estate is a numbers game. If you get yourself in front of enough people you will create a successful business. People will always be moving! Jobs change, kids graduate, people retire and life goes on! Agents:  Learn to listen to fears of your clients and hold their hands through this scary time. People will be grateful and become customers for life. Stay educated on what loans and credits are available to your clients...
