There was an article in REALTOR(r) Magazine a while back where the buyers purchased a house and the neighbors were a real problem. It was not disclosed on the Sellers Disclosure and they sued the Agent and the previous home owneer and won.

Depends on the state licensing laws. In MA, it's "caveat emptor" and the seller is not required to provide a written disclosure. Only material items need be disclosed to a buyer.
