For Agency Disclosure absolutely! For a buyer/broker agreement I would love to but more often than not they wont sign it.  It just isnt the norm here. I wish it was though.

No, I feel that says "I don't trust you", but that's my view.  Now I have used it once and only once, when I went to show an off market listing to a buyer.  I gave them the option of signing it and they declined.  Showed them the house and they ended up not being able to stretch enough for it, so it was a moot point.

I used to but in Wisconsin we no longer have to do that.  So I usually explain the buyer agency agreement to the customer and ask them to let me know after shopping with me a few times so they know if I'm the agent they would like to work with.

An Agency disclosure is mandated by the STATE and the rules for when and how it is disclosed is different for each state. This tells the consumer who you are working for.

A Buyer Broker agreement is usually an optional agreement that the agent may or may not choose to use. This asks the consumer to sign an exclusive right to represent contract which ties that person to your broker for a certain period of time.

These are two totally seperate things...

Yes, it is state law.  Consumers must sign something saying they have been advised about agency;  it does not have to be a buyer brokerage agreement, they can opt to be unrepresented, but they must sign a disclosure proving the agent has fully informed them of their options.

Most times, I don't have them sign until we are ready to write an offer if you are talking about an exclusive buyer agency agreement. If a buyer decides they really don't want to work with you, they'll find a way out of the agency agreement. And if they want out, what would you do? Hold them hostage?

 

If you're asking simply about a form explaining agency, I provide that at first substantive contact. But this form doesn't obligate them to anything in terms of a relationship.

I'm a new agent been licensed about a month now. I have a client that's looking to buy and we have been talking for about 2 weeks nowthrough text and over the phone. Monday I pulled out my step by step buyers guide and saw I needed to get a disclosure signed. Had completely forgot about it. Client came to an open house I would say we had an implied contract. But he comes in Saturday and we going look at more houses and I will get him to sign the form. But I totally forgot about it.
