I would try to take the high road and explain to him that what he did was inappropriate and explain why it was inappropriate so that he understands going forward how to be a good realtor. Then I would fire his sorry *** and never look back. Life is too short for nonsense like that.

Something similiar to that happened in our market. The photographer saw so many homes and watched them sell that she became an agent.  However, she does not take photos for any of us any more.

Wanda,

I would ask the photographer what he was thinking when he did that, and did he realize that this was against all the established protocol of agents working together?  And I would not use him again and report it to his broker.  A

I would have a few words with the photographer and not use this person again. I would hesitate to use a photographer who is a real estate agent unless the person is on my team.

First, I would have a very not so pleasant conversation with that photographer about tortious interference with someone else's client. Then I would find another photopgrapher.

Wanda Kubat-Nerdin If I know that photographer has got the real estate license, I would not bring him/her in for pictures.

Now if I don't know about it and I find that out, that's our last assignment together, unless we have written agreement not to interfere with our respective business.

I think that is very unprofessional, and would have a conversation.   Probably would not use them again, if they are so willing to "cross the line".

Photography sounds like "clicky clicky", not "chatty chatty". If he is a good photographer and you have an established relationship with him, give him the benefit of the doubt. Call him and let him know he crossed the line by engaging your seller in a discussion about real estate services. Ask him if its going  to be a problem to refrain going forward. Otherwise, just don't hire him again and be done with it. Poachers are short lived in our industry.

Call his broker!! My second thought is how much do you trust your client?  I've heard some tall tales from one of my sellers recently...so be sure of the facts before you leap.

Lower the boom on the photographer, speak to their broker, and find a new photographer and tell the violating party why. He has to learn ethics.

There are so many folks with licenses out there, many of them part time in real estate, that this happens more than it should.  It deserves a frank discussion for sure and I would not use them again, either. A call to the broker might depend on the way they handled our discussion.

Good evening.  There is no benefit of the doubt here in my opinion. If seller has relayed accurate information this "photographer" knew exactly what they were doing.  Confronting them would only bring excuses and BS.  Don't use them again and let them know why.   Dollars always speak loudest.  mark

I would certainly pick up the phone or see the photographer/r.e.agent in person.  If they are new, perhaps they "forgot" the ethical Code they are to adhere to and may need to be reminded.  I would certainly call the broker, as a courtesy, and inform them of the error.  I would follow up with email to the broker as well.  You never know if this happens again . If it does, you can show, in writing, that there was a previous issue and it may need to be reported to the State.  I would handle it calmly and professionally, but very sternly, so the agent is aware it can not ever happen again.

Assuming you know of another photographer you can use or you're prepared to take the photos yourself, I'd let this one know you'll no longer need his services and explain why.  Being new to real estate, it's possible he may not understand that what he did was wrong.  I doubt he'll ever do it again if he doesn't want to lose that income.
