As galling as it might be, is $2,000 worth starting over with a new buyer for your sellers, given the timing of everything?

If it is, then play hardball and tell them to take a hike. No report, no credit.

If it is worth $2,000 just to stop the madness and get to closing, then there it is.

It really depends on looking at the goal line and deciding which route gets you there - and not focusing on the sleazy tactics of the buyers and their agent.

230,000 - it's a good market, my area recently slowed a little. My clients offered to do the repairs but they dont want that, they just want a price drop. Yes it's a standard contract, we have it contingent on us buying another property that we have under contract and have both transactions timed together at the moment along with the one we are buying new purchase.

The repairs are about 20 dollars, we had a contractor come in that was laughing at the email I had claiming 2000 was low for all this work. I asked for a report to make sure we were talking about the same things, but she refuses to give us one to show us what she is talking about.

Repairs? What repairs?
If the buyer won't show you his, then hold his feet to the fire and hold your ground.
If he walks, some deals are meant to die. Everybody needs to be reasonable.
Does your contract provide for the seller to receive a copy of the inspection report?

Sounds like a scammer. I love the we want to buy your house buyers but we want 2K in fictitous repairs.  Call their bluff ... send them packing. In my experience, once they start chisling away at the sellers wallet they never stop.

Not sure who is pulling the strings here, the agent or buyer.  Sounds like a game player agent / buyer to me.  If they are playing this game up front regarding repairs what are they going to do after the final walk-through?  I would be very suspicious of this agent / situation.

It all depends on the seller motivation, the market/competition and circumstances.  $2K is not really much to lose a sale if they are otherwise qualified.

I just can't imagine an agent requesting a price drop in lieu of repairs who doesn't come with justification for same. Unless sellers won't risk losing the contract, I'd tell the buyer side to pound sand (politely, of course) or offer to do repairs upon receipt receipt of report. I don't understand how your seller had a professional contractor look at repairs when you don't have a copy of the inspection report. Seems odd that a house has only a $20 repair.

Just tell them the option your seller will perform the repairs. See what their response is (which it sounds as if you are beyond this), and then respond back with the seller will or will not perform the repairs "Best, Last & Final offer". See if they accept it, if not then get a release and sell it to someone else. Not sure how your contract reads, but ours has a "Best, Last & Final" clause in the contract. Best of luck.

I would demand the report and 2 verified estimates. I would provide my own estimates and try to include the buyer in the conversation so they know what the agent is doing. Many buyer agents try this ploy because many Sellers will give in.

Think it is time to review the contract. Probably need an inspection reoprt of the problems to fix them within the parameters of the contract. In the meantime do the $20 of repairs so the issues won't arise again when this agent blows the deal.

In Oklahoma the inspection is a contingency and you have limited days to provide it to the seller. The contract would be mull and void without it.

The Inspection Report paid for by the Buyer is theirs.. they don't have to share it if they don't want to, but in this case, it would be in their best interest if they want to proceed with the purchase.  I would send them the specific information regarding the repairs. If they do not provide that, I would advise my Seller not to drop the price, counter back again with the same price and no extension if the buyer agent is not willing to supply the information in the inspection report.

In Northern Virginia our Home Inspection Contingency requires a COMPLETE report be delivered for any HI where the buyer is requesting ANYTHING regarding the HI contingency. I assume you are dealing with some sort of HI contingency your contingency in your area likely says something similar regarding the buyer being required to submit a full copy of the report when requesting any repair or in this case price change.

Check with your broker but your clients as well as the buyers need to follow what is written in the contract. Hope this clears things up for you feel free to let me know if I can help you in any way Amanda Brown

Homes are sold in as-is, where-is condition.  Repairs can help facilitate the transaction.  It appears that the buyer side will not furnish a report, which is weird, but fine.  The seller must decide if they want to lower the price, reject the request or propose something else.

That said, it sounds like the buyers simply wish they got the property for 2k less.

End this one way or another.  You cannot allow it to drag on.  If the sellers wish to respond that they will not drop the price, the buyers may walk.  If they do, move on to the next.

We don't request copies of home inspection repairs because of the liablity so a buyer states what their objeciton is and we do the math.

What does the contract say?  If it requires a copy of the report then reference the paragraph in the contract.  Is the seller willing to lose the buyer if they don't reduce the price?

Tough situation to be in given they are buying a house contingent upon selling this house that is supposed to simultaneously close. Does your contract stipulate that they must provide copies of inspection report pages that justify their request? Our contracts specifically say that. But, regardless you have to give them the choices and consequences and let them decide. Call their bluff, play hardball and see if the buyers stick around? But what if they don't. Will your sellers regret losing the buyers and potentially also their new home as a result? Or take it, regardless of the situation and close on both as scheduled, but with $2k less in their pockets. Risk vs benefits and seller's choice here. -Kasey

Until they serve "Notice" it really does not matter.  I would suggest to just ignore the request and move on toward closing since their inspection period will expire and they will have no recourse after that time.

I don't know about your state rules and contract terms. But in AZ, all repair claims must be supporeted by acceptable documentary evidence - hence an inspection report by a licensed home inspector. Otherwise, the claim is...... ZERO.

So check the contract for what it says.
